After passing the proposed legislation against triple talaq in India, the Modi government is now in an attempt to pass this bill in the Rajya Sabha. Despite not having a majority in the Rajya Sabha, the Modi Government will try to ensure that the bill related to the Muslim women is also passed from the Upper House.
At the same time, the All India Muslim Personal Board opposing this law is preparing to make changes in Nikahnama. The Muslim Personal Law Board has taken these steps to stop triple talaq at one go. Under this, a model Nikahnama is being brought. There will be a condition of not giving triple talaq at a time during the Nikah.
Board spokesman Maulana Khalilurrahman Nomani told the news agency PTI that a model Nikahnama is being brought. Nomani said, "A column will be added in this model Nikahnama. This column will say that I will not give triple talaq.''
This column will be ticked during the Nikah and it will be confirmed by the bridegroom's signature on the Nikahnama (marriage certificate). According to the Personal Law Board, once the tick on this column, the man will not be able to give triple talaq to his wife. That means that no man will be entitled to divorce his wife by speaking triple talaq at a time, and if he does so, divorce will not be considered.
Board spokesman Nomani said that the Muslim Personal Law Board is strictly against triple talaq at a time. But in some circumstances it has been recognized. There are many cases in which women themselves appeal to triple talaq at a time.
