Supreme Court Upholds Execution of Four Accused in Nirbhaya Gangrape Case

After nearly four and a half years, the Supreme Court has upheld the execution of the four convicts while presenting the historic judgment in the Nirbhaya gangrape case today (May 5th). Describing the scandal as a tsunami of shock, the court said that the gangrape scandal had shattered the whole country. The court remarked that in the case the arguments given by Amicus Curie were not enough, therefore the convicts can not be given any concession.

The Bench of Justices Deepak Mishra, Justice R Bhanumati and Justice Ashok Bhushan unanimously passed this ruling. While declaring the judgment, Justice Bhanumati, quoting Swami Vivekananda, wrote, "The best way to measure the progress of a country is to deal with women of that country."

Justice Bhanumati wrote that crime against women not only hurts the dignity and respect of women, but also affects the peace and development of the society.

She remarked that children should be given a specific type of education to ensure the reputation of women in society.

Justice Bhanumathi further wrote, "I hope that the incident happened in the country's capital and the death of the victim, the crime against women for the society, ensuring the respect of women and opening the eyes towards gender equality. Will do it. "

She wrote that the responsibility of maintaining gender equality in the society, struggling for it and making people aware of gender discrimination is responsible for every citizen of the society.

Justice Bhanumati also wrote that the battle of the Gender Justice in the society can only be won when people are made sensitive, the legislative provisions will be followed in a logical and correct manner and in order to prevent violence against women, Steps will be taken. At the same time, she also talked of bringing about a change in the mind set of society.

On December 16, 2012, 23-year-old paramedical student was gang-raped in a moving bus in south Delhi and her genitals were tampered with. She was later thrown out of the moving bus with her boyfriend. On December 29 of that year, the victim was died in a hospital in Singapore.

In this case, a total of 6 people were accused. One of them, Ram Singh, had committed suicide by hanging him in Tihar Jail, due to being a teenager of an accused, he was sent to Juvenile house for three years by the Juvenile Court. Now he has been released. The Supreme Court has upheld the death sentence of the remaining four convicts Mukesh, Pawan, Vinay Sharma and Akshay Kumar Singh. On March 13, 2014 after the decision of the Saket court, the Delhi High Court sentenced him to death. All four of them had appealed to the Supreme Court against it. All four of the culprits now have the option of sending mercy petitions to the President. Decision on the date of hanging can be decided only after rejecting the petition from there.
