In India, the Supreme Court has agreed with the wishes of a girl and said that she is now an adult and deserves to use her independence. The court further said that courts should not be 'Super Guardian'.
Indeed, to keep this girl in his/her custody, her parents living separately are fighting legal battle. A bench comprising Chief Justice of India Deepak Mishra and Justice AM Khanvilkar and Justice DY Chandrachud talked to an 18-year-old girl in a crowded courtroom. The girl said that she is adult and is studying in Kuwait and wants to be with her father.
The court said that the girl said without hesitant that she intends to return to Kuwait to make her career. In such a situation, we believe that being an adult, she is entitled to walk in accordance with her preference, and the court can not consider this aspect whether she is under pressure of her father or not. Significantly, the girl's mother in Kerala wants to keep her under her protection. Her father lives in Kuwait.
The court was hearing a petition filed by a woman from Kerala who was demanding contempt proceedings against her husband living in Kuwait separately from her. The woman argues that her husband is defaming the order of the court on the subject of conservation of her daughter and the son. The girl is now adult, while the boy is still a minor. Settling the case, the court said that the father will have to pay 50,000 rupees to his mother on every trip to meet his son.
