Supreme Court ready to hear on triple talaq law in India

The Supreme Court has agreed to hear the three petitions challenging the law making triple talaq a punishable offense in India. Also, the Supreme Court has issued a notice to the Central Government in this regard.

The petition has challenged the constitutional validity of the Muslim Women (Protection of Marriage Rights) Act, which was passed in Parliament only last month.

Supreme Court Justice NV Ramanna has sent a notice to the Government of India.

Jamiat Ulema-e-Hind, one of the petitioners, has said that under this law, triple talaq was made a non-bailable offense so that Muslim men could be jailed for three years while leaving wife in the same India is not a crime is believed.

The organization said that the provision of three years' imprisonment under this law is' inconsistent and excessive '.

The bill on triple talaq was passed in the Rajya Sabha last month despite heavy opposition from the opposition.

The Modi government in its last tenure tried to make a law to declare triple talaq illegal.

But the matter went to court and after hearing the views of different parties, the Supreme Court on 22 August 2017 declared the triple talaq illegal and ordered the Center to make a law.

The government then brought a bill on triple talaq which was passed by the Lok Sabha in December 2017.

But the bill could not be passed from the Rajya Sabha the following year, after which the government declared ordinance three divorces invalid in September 2018.

It was opposed but the Modi government, which came back to power with a thumping majority, got the bill passed by the Lok Sabha on 25 July 2019 and the government was successful in getting the bill passed by the Rajya Sabha on 30 July five days later.

However, the Congress, Samajwadi Party, DMK and Rashtriya Janata Dal accused the bill as 'biased, unconstitutional and unilateral', alleging that 'the Modi government has passed it through juggling of numbers'.
