The hearing in the Supreme Court began on Thursday on the issue of triple talaq cases. The constitutional bench of five judges of different religions are hearing this. The court said, they will see whether the triple talaq are integral part of religion or not.
Apart from this, the Supreme Court also made it clear that polygamy will not be heard in this issue, although Halala can be heard.
The Supreme Court had decided to hear this sensitive issue during the summer vacation.
Thursday was the first day of the holiday. The Supreme Court said that they will look at the issue whether the triple talaq are the basic part of religion. We will also look at the issue as to whether the triple talaq are part of the fundamental right to be applied.
Although the Supreme Court said that the issue of polygamy in Muslim can not be part of its interpretation.
The five judges of the Supreme Court in the bench are the five religions. These judges include Chief Justice JS Kher (Sikh), Justice Courian Joseph (Christian), RF Nariman (Parsi), UU Lalit (Hindu) and Abdul Nazir (Muslim).
The judges of the Supreme Court belong to any religion, they take decisions only and only in the light of Indian Constitution in the court.
Six petitioners related to triple talaq are Quran Sunnat Society, Shayara Bano, Afreen Rehman, Gulshan Parveen, Ishrat Jahan and Atiya Sabri.
The All India Muslim Personal Law Board (AIMPLB) had told the apex court that triple talaq are an internal matter of Islam and the board will make general opinion on the matter in a year and a half.
Although the Shi'a Muslim Personal Board has supported triple talaq.
Nearly 100 Muslim intellectuals and professionals, while writing an open letter, opposed the triple talaq, saying that this is not an essential part of Islam.
