In the case of the repatriation of former Uttar Pradesh cabinet minister Gayatri Prajapati, in the case of grant of bail, the process of investigation has started against the Special Judge (Paxo Act). The investigation is to be completed by April 30.

The bench, chaired by Chief Justice DB Bhosale, had expressed objection to the special judge's intention and goodwill to grant bail to Gayatri Prajapati and two others on the last day. Later, the High Court had suspended the Special Judge (Poxo Act) Omprakash Mishra, who sanctioned the bail and ordered a departmental inquiry against him. Additional District and Sessions Judge Omprakash Mishra retires on April 30

Significantly, the Chief Justice had said that the manner in which the judicial officer is going to retire on April 30 is very objectionable. According to the facts of the case, the bail application of Gayatri Prajapati was filed on April 24. The Special Judge fixed the hearing on the next day. On 25th April, Dissident sought time to present the full case diary, but the Special Judge dismissed the petition saying that ADGC is ready for debate with the available case diaries. While seeking direction from him for proper instruction in the case, three days was sought.

The suspension of the Special Judge (Poxo Act) Om Prakash Mishra is not the first case in the judiciary. Whenever such flame came to the judiciary, the High Court administration took strict measures.

A judge accused in the PF scandal of Ghaziabad could not be permanent, and later, while remaining in a job, remained OSD, could not become a district judge. Only a few weeks before a complaint was received, a few other files had been removed from the rest of the week before retirement. Investigation against one ADJ who is stationed in Gorakhpur is still going on. He went to the transfer and stayed there in a very expensive hotel. If the complaint was received against them, the High Court administration suspended them and sat on the probe. It is said that the investigation is still going on.
