The Central Government has stamped the Triple Talaq bill in India. Now the bill will be passed in both the Houses for giving a legal shape. It will be presented in the winter session beginning December 15. The session ends on January 5.
It has been said in the draft bill prepared by the central government that Triple Talaq will be illegal at one time and the husband who does so can be sentenced to three years in jail. Triple Talaq given in any format (oral, written or electronic) will be considered illegal. If a woman is given a triple Talaq, then she can demand the maintenance and livelihood from the magistrate for herself and her minor children. The magistrate will decide how much livelihood they have to pay. For the custody of minor children, the victim may plead with the magistrate.
According to the PTI report, the draft of 'Muslim Women Protection of Rights on Marriage Bill' has been prepared by the Inter-Ministerial Group, led by Home Minister Rajnath Singh.
Significantly, on August 22, the Supreme Court had ordered the government to enact the law within six months, while declaring Triple Talaq as unconstitutional. The bench of the five judges had a hearing on this matter. Two judges were in favor of Triple Talaq, while three against it. According to the majority, decision of the three judges was decided by the Bench.
The bench included Justice JS Kher, Justice Kurien Joseph, RF Nariman, UU Lalit and S. Abdul Nazir. The trial of this case started on 11th May. The judges had reserved their verdict on May 18 in this case.
Tell you that due to lack of law, the practice of Triple Talaq is still going on in the Muslim community at one go.
On December 9, a man in Uttar Pradesh divorced his wife because he had joined a rally supporting Prime Minister Narendra Modi in support of Talaq Talaq. The matter was from the Englishganj mohalla of Bareli's fort area, where the resident of Saira, her husband, Danish Khan, beat not only her but also brought her out of the house with a year old baby. Earlier Saira had joined a rally on Thursday (December 07) on behalf of Mera Haq Foundation.
