In the case of a politically sensitive 2G spectrum scam in India, the special court acquitted all the accused, including former India's communications minister A Raja and DMK leader Kanimozhi, on Thursday.
The special court said in its verdict that the prosecution has failed miserably to prove charges against the accused in this case. Special Judge OP Saini in the verdict included former communications secretary Siddhartha Behura, Raja's former private secretary RK Chandolia, Swan Telecom's promoters Shahid Usman Balwa and Vinod Goenka, Managing Director of Unitech Limited Sanjay Chandra and Reliance Anil Dhirubhai Ambani Group's (RADAG ) three top executive officer Gautam Doshi, Surendra Pipara and Hari Nair including 15 other accused were acquitted.
In this case, the Central Bureau of Investigation had alleged that during the allocation of 2G spectrum licenses, revenue loss of Rs. 30,984 crores was made. The Supreme Court had canceled these allocations on February 2, 2012.
Special Court acquitted A Raja and DMK chief M Karunanidhi's daughter Kanimozhi in the trial of the Enforcement Directorate in the case of money laundering during the investigation into the 2G spectrum scam. In its charge sheet, the Enforcement Directorate had also made accused of DMK chief M Karunanidhi's wife Dayalu Ammal as accused. It was alleged that promoters of Swan Telecom (Private) Limited (STPL) gave Rs 200 crore to Kalaignar TV, operated by the DMK.
Along with them, the court has acquitted Shahid Balwa and Vinod Goenka of STPL, Asif Balwa and Rajiv Agrawal, director of Kusegaon Fruits and Vegetables Pvt Ltd, Sharad Kumar, Director of Kalaignar TV, Bollywood film producer Karim Morani and P. Amritam including 16 other people.
Judge O. P. Saini Special Court constituted on March 14, 2011 for hearing of 2G case has acquitted Essar Group promoters Ravi Kant Ruia and Anshuman Ruia and six others in connection with the 2G scam investigation.
Apart from Ruia, the court has acquitted Loop Telecom promoters IP Khaitan and Kiran Khaitan and Vikas Sarraf one of the directors of Essar Group, Loop Telecom Limited, Loop Mobile (India) Limited and Essar Teleholding Limited.
In a jam-packed courtroom, the judge said, "I have no hesitation in saying that the prosecution has failed miserably to prove any charge against any accused."
In three cases, the special court has ruled on Thursday. There were a total of 35 accused including many companies. In the first case, prosecutor CBI had made 17 people accused, the second case was that of the Enforcement Directorate, in which 19 people were accused. Eight people, including promoters of Essar, were accused in the third case.
All the accused, including Raja and Kanimozhi, have welcomed the decision and DMK activists celebrated on the acquittal of their leaders.
